Nutzungsbedingungen

1. Zugang

1.1 Die Commerzbank International S.A. (im Folgenden "Die Bank") stellt in gewissen Räumlichkeiten freiwillig und unentgeltlich über ein "WiFi Netzwerk" einen Internetzugang bereit.

1.2 Soweit die technischen Ressourcen der Bank es erlauben, kann jede Person einen Zugang erhalten (im Folgenden "Nutzer"), die über ein geeignetes Endgerät verfügt, am Empfang der Bank nach Feststellung der Berechtigung den erforderlichen Zugangscode erhalten und nach Eingabe des Zugangscodes die Geltung dieser Nutzungsbedingungen akzeptiert hat.

1.3 Für die fehlerfreie Funktion seines Endgeräts ist der Nutzer alleine verantwortlich.

2. Leistungs- und Nutzungsumfang

2.1 Die Bank bemüht sich um eine hohe Verfügbarkeit des "WiFi Netzwerks", ist jedoch zu keinem bestimmten Ergebnis verpflichtet. Die Bank kann eine Störungsfreiheit des Zugangs zum Internet nicht gewährleisten. Sie behält sich das Recht vor, die Nutzung des "WiFi Netzwerks" ganz oder teilweise ohne vorherige Mitteilung zu unterbrechen, kurzzeitig einzustellen oder zu ändern, insbesondere um die Wartung sicherzustellen, ohne dass die Unterbrechung oder Einstellung einen Schadensersatzanspruch jedweder Art zur Folge hätte.

2.2 Der Aufruf von Seiten mit rechtswidrigem Inhalt ist ebenso untersagt wie jegliche Verwendung, Übertragung oder Verbreitung von rechtswidrigen oder gegen die guten Sitten oder die öffentliche Ordnung verstoßenden Daten.

2.3 Insbesondere jegliche gegen Rechte Dritter, z.B. urheberrechtliche Bestimmungen, verstoßende Nutzung ist untersagt.

2.4 Die Bank behält sich das Recht vor, den Zugang zum "WiFi Netzwerk" einseitig und ohne vorherige Benachrichtigung jederzeit einzustellen oder zu verweigern, insbesondere falls ein Verstoß gegen eine der Bestimmungen dieser Nutzungsbedingungen festgestellt wird und ohne dass der Nutzer Schadenersatz gleich welcher Art verlangen kann.

2.5 Nutzer- und Verbindungsdaten werden entsprechend den gesetzlichen Vorgaben gespeichert.

3. Haftungsausschluss der Bank/Verantwortlichkeit des Nutzers

3.1 Eine Haftung der Bank für jeglichen Schaden, z.B. Virenbefall, Datenverlust und -diebstahl zum Nachteil des Nutzers ist ausgeschlossen.

3.2 Der Nutzer alleine ist für die Inhalte und Texte und Meinungen verantwortlich, die er über das "WiFi Netzwerk" bereitstellt bzw. zum Ausdruck bringt. Er alleine ist für sämtliche direkte oder indirekte Schäden jedweder Art verantwortlich, die Dritten aufgrund seiner Nutzung des "WiFi Netzwerks" entstehen und verpflichtet sich, die Bank für sämtliche Regressforderungen Dritter schadlos zu halten.

4. Änderung der Nutzungsbedingungen/Anwendbares Recht/Gerichtsstand

4.1 Die Bank behält sich das Recht vor, die vorliegenden Nutzungsbedingungen jederzeit zu ändern.

4.2 Auf die Nutzungsbedingungen findet das Recht des Großherzogtums Luxemburg Anwendung.

4.3 Die Bank kann den Nutzer bei jedem zuständigen Gericht verklagen. Die Bank selbst kann nur an dem im Großherzogtum Luxemburg zuständigen Gericht verklagt werden.

 

Terms of Use

1. Access

1.1 Commerzbank International S.A. (hereinafter "the bank") offers voluntarily and free of charge in certain premises an access to the internet via a "WiFi network".

1.2 As far as the technical resources of the bank allow it, an access may be granted to any person (hereinafter the "user"), who has a compatible terminal equipment, who has been identified as authorised user and received an access code at the reception of the bank and who confirms after entering the access code the application of the terms of use.

1.3 The user alone is responsible for the functioning of his/her terminal equipment.

2. Scope of service and use

2.1 The bank undertakes efforts for a high availability of the "WiFi network", but is not obliged to any results. The bank cannot guarantee a failure-free access to the internet. It reserves the right to interrupt, suspend temporarily or modify, without prior notice, completely or partially the use of the "WiFi network", especially in order to assure its maintenance, without the interruption or the suspension giving right to any compensation.

2.2 It is neither permitted to call up any sites with unlawful content nor to use, transfer or send data with illegal content or data that goes against good moral standards or the public order.

2.3 In particular, any use contravening the rights of third parties, e.g. copyright laws, is prohibited.

2.4 The bank reserves the right to suspend or refuse access to the "WiFi network", at any time, unilaterally and without prior notice, without the user being able to demand any indemnity, especially in case of detection of breach of one of the clauses of the terms of use herein.

2.5 The bank stores the data of the user and the traffic-related data according to the legal requirements.

3. Exclusion of liability of the bank/Responsibility of the user

3.1 Any liability of the bank for any damages, e.g. virus infestation, data loss and -theft to the detriment of the user is excluded.

3.2 The user alone is responsible for the content he provides and texts and opinions he expresses via the "WiFi network". Only the user is responsible for any direct or indirect prejudice causes to third parties due to his use of the "WiFi network" and undertakes to ensure that the bank is not held liable for any claim made by third parties.

4. Modification of the terms of use/Applicable law/place of jurisdiction MODIFICATION OF THE

4.1 The Bank reserves the right to modify the terms of use herein at any time.

4.2 The terms of use shall be governed and construed in accordance with the laws of the Grand Duchy of Luxembourg.

4.3 The Bank may take action against the user at any competent court. Action may only be brought against the Bank at the competent court of the Grand Duchy of Luxembourg.
